Terms & Conditions

These terms and conditions (the "Terms") set out the basis on which Bio-Coding Labs ("Bio-Coding Labs", "we", "us" or "our") makes this website and our products available to you. Please read them carefully before placing an order. By accessing the site, creating an account or buying from us, you confirm that you have read, understood and agree to be bound by these Terms. If you do not accept them, you should not use the site or order our products.

1. Research use only: the most important term

Every product listed and sold by Bio-Coding Labs is supplied strictly and exclusively for in-vitro laboratory and scientific research use only. Our products are not medicines, not dietary supplements, not cosmetics and not food, and they have not been assessed or approved by the MHRA or any other regulatory body for any therapeutic, diagnostic or preventative purpose.

By placing an order you expressly acknowledge and agree that:

  • the products are not for human or animal consumption in any form, and must never be ingested, injected, inhaled, applied to the body or otherwise administered to humans or animals;
  • the products will be used solely for legitimate controlled laboratory research carried out by, or under the supervision of, a suitably qualified professional;
  • you possess the technical knowledge, training, facilities and equipment required to handle, store and dispose of research chemicals safely and lawfully;
  • you accept full and sole responsibility for any handling, use, onward supply or misuse of the products once they leave our possession.

Nothing on this site is medical, clinical or scientific advice, and nothing should be interpreted as a recommendation or instruction to use any product in or on the body. Any such use is strictly prohibited and entirely at the user's own risk.

2. Eligibility, accounts and your responsibilities

You may only use this site and place an order if you are 18 years of age or older and are a qualified researcher, or are purchasing on behalf of a recognised research institution, laboratory or business. By ordering you confirm that you meet these requirements and that you are buying the products in that capacity.

If you create an account, the information you provide must be accurate, current and complete, and you are responsible for keeping it up to date. You are solely responsible for safeguarding your login details and for any activity that takes place under your account. Please tell us straight away if you suspect any unauthorised use.

3. Products, descriptions and accuracy

We take reasonable care to describe our products accurately, including their specification, concentration and batch testing. Even so, we cannot guarantee that descriptions, images, colours, packaging or other details shown online are wholly free from error or will exactly match the item you receive, as on-screen depictions are for illustration only.

Where a Certificate of Analysis (CoA) is published for a batch, it reflects the testing carried out on that specific batch. We reserve the right to correct any errors, inaccuracies or omissions, and to change product information at any time without prior notice. Product availability is not guaranteed and listings may be amended or withdrawn at our discretion.

4. Orders and acceptance

When you submit an order you are making an offer to purchase the products in your basket subject to these Terms. An order confirmation email acknowledges that we have received your order; it does not by itself mean we have accepted it. A binding contract is formed only when we dispatch the products or otherwise confirm acceptance.

We may accept or decline any order, in whole or in part, at our discretion and for any lawful reason, for example where we doubt the order is for genuine research use, where stock is unavailable, where a pricing or product error has occurred, or where we suspect fraudulent or unauthorised activity. If we cannot fulfil an order you have paid for, we will refund the amount charged.

5. Pricing and billing

All prices are shown in pounds sterling (GBP, £). We work hard to keep pricing accurate, but prices and promotions may change at any time without notice. Unless a listing states otherwise, prices exclude any applicable taxes and delivery charges, which are added at checkout where relevant.

If we discover that a product has been listed at an incorrect price, we are not obliged to supply it at that price. We will let you know before processing the order and give you the option to proceed at the correct price or cancel for a full refund. You agree to provide current and valid payment and billing information at the time of purchase.

6. Payment

Payment is taken at checkout through our third-party payment providers using a secure, encrypted connection. We do not store your full card details on our own servers. By submitting payment information you confirm that you are authorised to use the chosen payment method. We reserve the right to cancel or hold any order where payment cannot be authorised or where we suspect fraud.

7. Shipping and delivery

We currently ship within the UK (and Ireland where stated), using plain, unbranded and discreet packaging. Orders placed before our daily cut-off on a working day are typically dispatched the same day, with next-day UK delivery, and shipping is free on UK orders over £110. Delivery timescales are estimates only and are not guaranteed.

Once an order has been handed to the carrier, risk of loss or damage passes to you. We are not liable for delays, losses or other issues caused by the carrier, by incorrect delivery details supplied by you, or by circumstances beyond our reasonable control. It is your responsibility to ensure that someone is able to receive the parcel and that the products are stored correctly on arrival.

8. Returns and refunds

Because our products are sensitive research materials, returns and exchanges are only accepted in line with this clause and applicable law. For health, safety and integrity reasons we cannot accept the return of products once their seal has been broken or where there is any sign of tampering, unless the item is faulty or was sent in error.

If your order arrives damaged, defective or incorrect, please contact us within a reasonable period of receipt with your order number and supporting photographs so we can put it right by replacement or refund. Approved refunds are made to the original payment method. Nothing in this clause affects any statutory rights you may have as a consumer under UK law.

9. Risk, disclaimer of warranties and limitation of liability

Our products and this site are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we exclude all warranties, conditions and representations not expressly set out in these Terms, including any implied warranties of satisfactory quality, fitness for a particular purpose, or suitability for any application other than the controlled in-vitro research for which the products are supplied.

You assume all risk arising from the purchase, handling, storage, use and disposal of our products. To the fullest extent permitted by law, Bio-Coding Labs shall not be liable for any indirect, incidental, special or consequential loss, nor for any loss, injury, damage or liability resulting from any use of the products that breaches these Terms, in particular any human or animal administration. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.

10. Prohibited uses

You agree not to use the site or our products for any unlawful or prohibited purpose. This includes, without limitation: administering products to humans or animals; reselling or onward supplying products for any non-research purpose; infringing our or anyone else's intellectual property rights; transmitting malware; attempting to gain unauthorised access to our systems; or harassing, abusing or defrauding others. We may suspend or terminate your access if you breach these Terms.

11. Intellectual property

All content on this site, including the Bio-Coding Labs name, logos, text, product descriptions, photography, graphics, page layouts and code, is owned by or licensed to us and is protected by intellectual property laws. You may view and use the site for your own legitimate purchasing purposes, but you may not copy, reproduce, republish, distribute or otherwise exploit any part of it without our prior written permission.

12. Privacy

Any personal information we collect through the site is handled in accordance with our Privacy Policy, which forms part of these Terms. The Privacy Policy explains what data we collect, how we use it and the rights available to you under applicable UK data protection law. Please review it alongside these Terms.

13. Changes to these terms

We may update or revise these Terms from time to time to reflect changes in our products, our practices or the law. The current version will always be posted on this page with its "Last updated" date. Any changes take effect once published, and your continued use of the site or placing of further orders constitutes acceptance of the updated Terms. We encourage you to review this page periodically.

14. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of England and Wales. You and Bio-Coding Labs agree to submit to the exclusive jurisdiction of the courts of England and Wales.
